LEGAL+ / INTERNATIONAL LITIGATION
Appeal a German
Judgment?
A judgment must be tested against the record – not simply against the disappointment of losing. I examine appeal deadlines, the court’s reasoning and the realistic grounds for challenging the decision.
THE APPELLATE POSITION
First the judgment.
Then the appeal.
An appeal does not begin by repeating the case. It begins by identifying a legal or factual error in the judgment.
A German court has issued a judgment and you disagree with the result. That alone does not make an appeal viable. The decisive question is whether the judgment can be attacked within the procedural limits of the second instance.
The analysis starts with the full judgment, the date and manner of service, the available appellate route and the first-instance record. Procedural admissibility and deadlines must be secured before the merits are debated.
Next comes the central question: did the court apply the law incorrectly, overlook decisive submissions or evidence, or base its decision on findings that can properly be challenged? New facts and evidence are not freely admitted on appeal.
I can review the judgment independently, including when another lawyer conducted the first instance. That assessment is a separate piece of work; it should produce a defensible recommendation, even if the answer is not to appeal.
IMMEDIATE APPEAL ASSESSMENT
What needs to be checked first?
An appeal has its own procedural requirements, cost implications and limited scope of review.
Secure the deadlines
When was the full judgment served, which appellate court is competent and what must be filed by which date?
Check admissibility
Are the statutory requirements for an appeal met? Does the decision allow an appeal, or is a particular form of leave required?
Read the judgment against the record
What did the parties submit and prove? Which findings and legal conclusions actually support the decision?
Evaluate grounds, risks and enforcement
Which errors could change the outcome? What are the cost consequences and is provisional enforcement an immediate issue?
The full judgment and evidence of service should be reviewed before a deadline is lost.
APPEAL / POINTS OF REVIEW
Where must the analysis focus?
The strength of an appeal lies in its specific grounds. These are the matters I examine when assessing the appellate position.
PROCEDURE & ADMISSIBILITY
REASONS & STRATEGY
I can examine the judgment separately from the question of who should conduct the appeal.
APPELLATE WORK / PERSONAL RESPONSIBILITY
A second opinion. A clear position.
The first-instance lawyer may stay involved. A judgment review can be commissioned independently of a later decision about appellate representation.
Discuss your judgmentA judgment deserves independent scrutiny
The lawyer who conducted the first instance necessarily knows the case from the inside. An independent review can help identify which findings are genuinely vulnerable and which criticisms will not carry an appeal.
I compare the judgment with the pleadings, evidence and hearing record. The goal is not optimism; it is a concrete and professionally justified assessment.
Personally conducted appellate proceedings
If I take over an appeal, I identify the decisive errors, prepare focused grounds and conduct the proceedings before the competent German appellate court.
If the opposing party challenges a judgment you have won, the same discipline applies to defending it. International clients can coordinate the review and initial work remotely.
PREPARING A JUDGMENT REVIEW
What documents should you send?
The judgment alone is not enough to assess whether an appeal has merit. The first-instance record matters.
SEND YOUR DOCUMENTS
Email the judgment, evidence of service and the essential pleadings. State immediately if an appeal or enforcement deadline may be running.
kontakt@legal-plus.euContacting me does not preserve, interrupt or extend an appeal deadline.
- The complete written judgment, including all reasons
- Proof of service and the date the judgment was received
- The statement of claim, defence and later pleadings
- Relevant exhibits and documentary evidence
- Minutes of hearings and available evidence-taking records
- Relevant court orders and procedural directions
- Any appeal already filed, correspondence or notice concerning enforcement
A reliable opinion requires comparison of the decision with the issues actually raised at first instance.
