period under transport law according to <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/439.html\" title=\"&sect; 439 HGB: Verj&auml;hrung\">\u00a7 439 HGB<\/a><\/div>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-557ac8a1 elementor-widget elementor-widget-text-editor\" data-id=\"557ac8a1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The limitation period under transport law pursuant to <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/439.html\">\u00a7 439 HGB<\/a> is one year from delivery of the transported goods and is therefore significantly shorter than the 3-year standard limitation period pursuant to <a href=\"https:\/\/dejure.org\/gesetze\/BGB\/195.html\" title=\"&sect; 195 BGB: Regelm&auml;&szlig;ige Verj&auml;hrungsfrist\">\u00a7 195 BGB<\/a>.<\/p><p>Due to this significant shortening of the limitation period, the question of the scope of application of the transport law limitation period is of great importance. I can report from experience that the question of whether a claim is subject to the statute of limitations under transport law or the standard statute of limitations often raises difficulties. In this respect, there are two &#8220;camps&#8221;, one of which takes a narrow interpretation and one &#8211; rightly &#8211; a broad interpretation.  <\/p><p>The following article summarizes the legal situation.<\/p><h3><strong>Wording of the law: Claims &#8220;arising from transportation&#8221;<\/strong><\/h3><p>Pursuant to \u00a7 439 para. 1 sentence 1 HGB, claims &#8220;arising from transportation&#8221; in accordance with the provisions of <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/407.html\" title=\"&sect; 407 HGB: Frachtvertrag\">\u00a7\u00a7 407-450 HGB<\/a> expire within one year of delivery of the goods.  <\/p><h3><strong>The limitation period under transport law in accordance with 439 HGB covers all claims in connection with transportation<\/strong><\/h3><p>Even though the wording of <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/439.html\" title=\"&sect; 439 HGB: Verj&auml;hrung\">\u00a7 439 HGB<\/a> regulates the limitation period for claims &#8220;arising from transportation&#8221;, the preferred view is that it <strong>covers all claims that are intrinsically linked to the transportation<\/strong>.<\/p><p>The purpose of the uniform limitation provision is to simplify the limitation provisions and make them clearer. Possible legal uncertainties due to different statutes of limitation for claims arising from a uniform factual situation are to be counteracted (see <a href=\"https:\/\/dejure.org\/Drucksachen\/Bundestag\/BT-Drucksache%2013\/8445\" title=\"Bundestagsdrucksache zu: Gesetz zur Neuregelung des Fracht-, Speditions- und Lagerrechts (Trans...\">BT-Drucksache 13\/8445<\/a> on Section 439 HGB). <\/p><p>This also includes, for example, claims arising from consulting services in connection with the organization of the transport, <strong>claims arising from customs clearance<\/strong> and claims for information (see OLG Nuremberg of 26.11.1974, NJW 1974, 501).<\/p><p>In particular, the statute of limitations also applies irrespective of the party asserting the claim and the legal grounds on which it is based. It is therefore irrelevant whether the carrier takes action against the principal or vice versa. (see <a href=\"https:\/\/dejure.org\/Drucksachen\/Bundestag\/BT-Drucksache%2013\/8445\" title=\"Bundestagsdrucksache zu: Gesetz zur Neuregelung des Fracht-, Speditions- und Lagerrechts (Trans...\">BT-Drucksache 13\/8445<\/a> on <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/439.html\" title=\"&sect; 439 HGB: Verj&auml;hrung\">\u00a7 439 HGB<\/a>).  <\/p><h3><strong>The limitation period under transport law pursuant to <\/strong><strong>439 HGB is not merely a limitation or exemption from liability within the meaning of <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/434.html\" title=\"&sect; 434 HGB: Au&szlig;ervertragliche Anspr&uuml;che\">\u00a7\u00a7 434<\/a>, <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/436.html\" title=\"&sect; 436 HGB: Haftung der Leute\">436 HGB<\/a><\/strong><\/h3><p>The opposing view, according to which <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/439.html\" title=\"&sect; 439 HGB: Verj&auml;hrung\">\u00a7 439 HGB<\/a> should be a limitation or exemption from liability within the meaning of <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/434.html\" title=\"&sect; 434 HGB: Au&szlig;ervertragliche Anspr&uuml;che\">\u00a7\u00a7 434<\/a>, <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/436.html\" title=\"&sect; 436 HGB: Haftung der Leute\">436 HGB<\/a>, is incorrect. In particular, this would mean that Section 439 HGB would only apply to claims of the parties to the transportation contract in question. This view cannot be substantiated. The application of <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/439.html\" title=\"&sect; 439 HGB: Verj&auml;hrung\">\u00a7 439 HGB<\/a> is not only possible via \u00a7 434 para. 1 HGB or <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/436.html\" title=\"&sect; 436 HGB: Haftung der Leute\">\u00a7 436 HGB<\/a>:    <\/p><h4>Justification of the law<\/h4><p>As explained above, the purpose of the uniform limitation provision of Section 439 HGB is to simplify the limitation provisions and make them clearer (explanatory memorandum to the government draft of the Transport Law Reform Act, <a href=\"https:\/\/dejure.org\/Drucksachen\/Bundestag\/BT-Drs.%2013\/8445\" title=\"Bundestagsdrucksache zu: Gesetz zur Neuregelung des Fracht-, Speditions- und Lagerrechts (Trans...\">BT-Drs. 13\/8445<\/a>, p. 77). This is the only way to ensure that <u>all<\/u> claims directly related to the transportation run concurrently (see <a href=\"https:\/\/dejure.org\/Drucksachen\/Bundestag\/BT-Drs.%2013\/8445\" title=\"Bundestagsdrucksache zu: Gesetz zur Neuregelung des Fracht-, Speditions- und Lagerrechts (Trans...\">BT-Drs. 13\/8445<\/a>, p. 77).  <\/p><p>The reference to <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/439.html\" title=\"&sect; 439 HGB: Verj&auml;hrung\">\u00a7 439 HGB<\/a> in the explanatory memorandum to <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/434.html\" title=\"&sect; 434 HGB: Au&szlig;ervertragliche Anspr&uuml;che\">\u00a7 434 HGB<\/a> and thus the clarification of the systematic relationships in the transport law regulations of the HGB is unambiguous, so that no serious doubt can arise as to the scope of <a href=\"https:\/\/dejure.org\/gesetze\/HGB\/439.html\" title=\"&sect; 439 HGB: Verj&auml;hrung\">\u00a7 439 HGB<\/a>.
