The BGH stated in its ruling of 16.11.2021 (case no. <a href=\"https:\/\/dejure.org\/dienste\/vernetzung\/rechtsprechung?Text=VI%20ZR%20100\/20\" title=\"BGH, 16.11.2021 - VI ZR 100\/20: Ersatz des entstandenen Reparaturaufwands durch Wiederherstellu...\">VI ZR 100\/20<\/a>): <\/p><p><em>&#8220;(&#8230;)<\/em><\/p><p><em>Contrary to the opinion of the appeal, however, the plaintiff is not deprived of proof of his allegations in this regard because he could be accused of obstructing evidence due to the sale of his vehicle in September 2017<strong>. However, by selling his vehicle, the plaintiff did not impede the defendant&#8217;s burden of proof, but at most his own. This is because he is obliged to provide evidence that his vehicle was completely and professionally repaired in accordance with the specifications of the pre-trial expert.  <\/em><\/p><p><em>Apart from this, the assumption of a frustration of proof does not lead to the legal consequence claimed by the appeal. <strong>If the prerequisites for the obstruction of evidence by the opponent of the
