planning to raise the limit on the amount in dispute for the jurisdiction of the local courts from \u20ac5,000 to \u20ac10,000 &#8211; a plan that could have considerable consequences for effective legal protection.<\/p><h2><strong>My thesis<\/strong><\/h2><p>The reform worsens the quality of legal protection, produces more appeals and misses its own goal of creating &#8220;proximity to citizens&#8221;. It makes savings in the wrong place and ultimately costs time, money and trust. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-690ef8ee elementor-section-stretched elementor-section-boxed elementor-section-height-default elementor-section-height-default elementor-invisible\" data-id=\"690ef8ee\" data-element_type=\"section\" data-e-type=\"section\" data-settings=\"{&quot;stretch_section&quot;:&quot;section-stretched&quot;,&quot;animation&quot;:&quot;zoomIn&quot;}\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-10ee0f7e\" data-id=\"10ee0f7e\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-1ec53129 elementor-widget elementor-widget-text-editor\" data-id=\"1ec53129\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2><strong>What the federal government is planning &#8211; and how it is being sold<\/strong><\/h2><p>The jurisdictional amount in dispute for the lower district court is to rise from \u20ac 5,000 to \u20ac 10,000. At the same time, individual matters will be assigned to the regional courts irrespective of the value in dispute, such as medical treatment, procurement and publications. The federal government expects &#8220;savings&#8221; in legal fees in the millions.  <\/p><p><strong>Justification (among others):<\/strong><\/p><p>Inflation since 1993, preservation of local court locations, proximity to citizens.<\/p><h2><strong>What is overlooked<\/strong><\/h2><h3><strong>1) Complexity has little to do with \u20ac10,000<\/strong><\/h3><p>Many proceedings under \u20ac10,000 are technically demanding: from questions of international procedural law to complex warranty constellations and often complex transport and CMR constellations. This belongs to specialized chambers, not to &#8220;citizen-oriented&#8221; local courts. The specialization modules of the draft are selective, but leave out central commercial law matters.  <\/p><h3><strong>2) More self-representation does not mean more justice &#8211; quality costs<\/strong><\/h3><p>There is no obligation to have a lawyer at the local court. This is precisely the aim of the &#8220;savings&#8221; effect. In practice, self-representation leads to incorrect applications, incorrect conduct of proceedings, additional workload for the court offices and &#8211; above all &#8211; more appeals. The \u20ac14.5 million &#8220;saved&#8221; in this way will be transferred to the second instance. The BMJ itself anticipates noticeable shifts to the appeal courts.    <\/p><h3><strong>3) Proximity to citizens  <\/strong><\/h3><p>Proximity may help in neighborhood law. In commercial law, legal representation and quality help. <\/p><h2><strong>What would really help<\/strong><\/h2><p>From my point of view, the following would help:<\/p><ul><li><strong>Say goodbye to the value in dispute &#8211; specialization by subject matter<br><\/strong>Concentration at specialized chambers regardless of the value in dispute: e.g. B2B sales law, transport\/CMR, international commercial cases, IT contracts. This brings quality to where it is needed. The specializations already provided for in the areas of medical treatment or procurement serve as models.  <\/li><\/ul><ul><li><strong>Digital, accelerated proceedings<\/strong><br>Genuinely accelerated proceedings up to \u20ac5,000, for example: standardized claim and response forms, mandatory early judicial advice, tight deadlines, digital taking of evidence. This saves time without compromising on quality. <\/li><li><strong>Compulsory legal representation in commercial matters<\/strong><br>Compulsory legal representation in commercial matters regardless of the amount in dispute. Anyone involved in a cross-border supply dispute needs professional litigation. This reduces the appeal rate and relieves the burden on the courts exactly where it counts.  <\/li><li><strong>Concentration models <\/strong><br>Economic chambers with supra-local responsibility. The background to such a dishonest approach is &#8211; obviously &#8211; not least the potential for blackmail associated with such an approach. This is because the party that finds itself &#8211; in breach of the jurisdiction agreement &#8211; exposed to a foreign lawsuit is regularly forced to take action abroad through lawyers in order to avoid legal disadvantages.
