It must answer the claim as filed. A point that is commercially important to the defendant may be irrelevant to the pleaded claim. A point that appears small may be decisive because the claimant relies on it as part of the legal basis.\n  <\/p>\n\n  <p>\n    The statement of claim therefore determines the first structure of the defence.\n  <\/p>\n\n  <h2>Typical defence issues<\/h2>\n\n  <p>\n    The relevant defence points depend on the case. A clear chronology can be more useful than a long narrative. It should show what was ordered, agreed, delivered, performed, rejected, paid, withheld, terminated or disputed.\n  <\/p>\n\n  <p>\n    For a client abroad, this usually means that documents must be collected early and organised according to the issues in the lawsuit. Emails, orders, order confirmations, invoices, delivery notes, acceptance records, defect notices, payment records and settlement correspondence may all become relevant.\n  <\/p>\n\n  <p>\n    It is usually not necessary to translate every document at the beginning. The first step is to identify the documents that matter. Translation can then be focused on the material that will actually be used.\n  <\/p>\n\n  <h2>Admissions, denials and explanations<\/h2>\n\n  <p>\n    A German defence should be precise about what is disputed and why. A general denial may be insufficient where the claimant has pleaded facts in detail and produced documents. At the same time, unnecessary admissions should be avoided.\n  <\/p>\n\n  <p>\n    This is particularly important where the defendant is outside Germany and the internal facts are spread across departments, subsidiaries, sales teams, project managers or local agents. Before a defence is filed, it must be clear who acted for which entity and what can be supported by documents.\n  <\/p>\n\n  <p>\n    The defence should therefore be prepared with the people who know the transaction, not only with the person who received the court papers.\n  <\/p>\n\n  <h2>Procedure and merits must be aligned<\/h2>\n\n  <p>\n    Even after the initial assessment, procedural issues may remain relevant. A defence that is strong factually can still be damaged by a procedural mistake. The court will usually work with the statement of claim, the statement of defence, further written submissions and the documents filed by the parties.\n  <\/p>\n\n  <p>\n    Informal explanations to the court or the opposing lawyer are not a substitute for a proper procedural filing. The defence must be submitted in the form required by the court and, where lawyer representation is mandatory, through German counsel.\n  <\/p>\n\n  <p>\n    For clients abroad, this is a practical advantage. This can usually be done by email, video conference and electronic document exchange.\n  <\/p>\n\n  <p>\n    The practical challenge is not distance as such. The challenge is to turn information held abroad into a defence that works before a German court.\n  <\/p>\n\n  <div class=\"lp-special\">\n    <p class=\"lp-special-label\">Travel to Germany<\/p>\n\n    <h2>Will you have to travel to Germany?<\/h2>\n\n    <p>\n      In many cases, the early phase of the defence can be handled without the client travelling to Germany. The essential work is document review, legal assessment, written submissions and communication with the court through German counsel.\n    <\/p>\n\n    <p>\n      Personal attendance may become relevant later if the court schedules a hearing, orders the personal appearance of the parties, wants to discuss settlement or takes evidence. Even then, travel is not always the only possible solution. Depending on the case and the court, video participation or dispensation from personal appearance may be considered.\n    <\/p>\n\n    <p>\n      No reliable defence strategy should promise that travel will never be necessary. But the question should be assessed at the right stage. In many commercial cases, the defence can first be organised and filed while the client remains abroad.\n    <\/p>\n  <\/div>\n\n  <h2>Hearings, judicial indications and settlement<\/h2>\n\n  <p>\n    German courts often use hearings not only for oral argument, but also to discuss the court&rsquo;s preliminary view, evidentiary issues and settlement. The written submissions usually shape what happens at the hearing.\n  <\/p>\n\n  <p>\n    A commercial settlement may be useful, but it should not be pursued separately from the defence. Settlement discussions should be aligned with the procedural position, the evidence, the cost risk and the strength of the claim.\n  <\/p>\n\n  <p>\n    For a client abroad, it is important to prepare hearing and settlement strategy in advance. The client should know what issues are likely to matter, what concessions are acceptable and what should not be said without instructions.\n  <\/p>\n\n  <h2>If the case started with a payment order<\/h2>\n\n  <p>\n    Some German disputes begin with a payment order. After an objection, the matter may move into ordinary proceedings. At that stage, the claimant must usually explain the claim more fully.\n  <\/p>\n\n  <p>\n    The defence then changes character. It is no longer only about stopping an enforcement order.
